4.1 Purchase Terms

• All sales are final once the product is dispensed
• Prices are displayed on the machine and may vary by location
• Payment must be made in full before product dispensing
• We accept various payment methods as indicated on each machine

4.2 Product Availability

We make reasonable efforts to:

• Keep machines stocked with advertised products
• Maintain product quality and freshness
• Update product selections regularly
• Honor advertised prices

However, product availability may vary due to supply chain factors beyond our control.

4.3 Machine Malfunctions

In case of machine malfunction:

• Do not attempt to repair or force the machine
• Report issues using the contact information on the machine
• Refunds or replacements will be provided for valid claims
• Keep payment receipts for refund processing

5.1 Program Participation

• Programs are available to students at partner institutions
• Enrollment may require institutional approval
• Participants must meet program-specific requirements
• Completion certificates are awarded based on performance

6.1 Accepted Payment Methods

• Mobile money (MTN Mobile Money, AirtelTigo Money, Vodafone Cash)
• Credit and debit cards
• Cash (where applicable)
• Institutional payment systems
• Digital wallet payments

6.2 Pricing and Charges

• All prices are in Ghana Cedis (GHS) unless otherwise stated
• Prices include applicable taxes
• We reserve the right to change prices with reasonable notice
• Transaction fees may apply depending on payment method

ESOG Africa retains all rights, title, and interest in our:

• Vending machine technology and software
• Training materials and curricula
• Trademarks, logos, and brand elements
• Website content and digital platforms
• Proprietary business processes and methods

7.2 User-Generated Content

When you submit content to us, you:

• Grant us a license to use, display, and distribute such content
• Represent that you own or have rights to the content
• Agree that the content does not infringe third-party rights
• Understand we may remove content at our discretion

7.3 Permitted Use

You may:

• Use our Services for their intended purpose
• Share information about our Services (with attribution)
• Access training materials as authorized

You may not:

• Copy, modify, or reverse engineer our technology
• Use our trademarks without permission
• Create derivative works of our content
• Compete with us using our intellectual property

9.1 Service Availability

We strive to provide reliable services but do not guarantee uninterrupted availability. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

9.2 Limitation of Damages

We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages caused by third parties or external factors
• Acts of God, natural disasters, or force majeure events

9.3 Product Liability

For products sold through our vending machines, our liability is limited to replacement or refund of the specific product. We are not responsible for allergic reactions or health issues unless caused by our negligence.

11.1 Termination by You

You may stop using our Services at any time. If you have an account, you may request account closure by contacting us.

11.2 Termination by Us

We may suspend or terminate your access to our Services if:

• You violate these Terms or applicable laws
• Your account remains inactive for extended periods
• We reasonably believe your account has been compromised
• You engage in fraudulent or abusive behavior
• Required by law or regulatory authorities

11.3 Effect of Termination

Upon termination, your right to use our Services ceases immediately. Provisions regarding liability, indemnification, and dispute resolution survive termination.

12.1 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us directly to resolve any disputes. Many issues can be resolved quickly through direct communication.

12.2 Governing Law

These Terms are governed by the laws of Ghana. Any disputes will be subject to the exclusive jurisdiction of the courts of Ghana.

12.3 Alternative Dispute Resolution

For qualifying disputes, we may agree to use mediation or arbitration as an alternative to court proceedings, subject to mutual consent.

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific Services, constitute the entire agreement between you and ESOG Africa.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

13.5 Force Majeure

Neither party will be liable for any failure or delay in performance due to circumstances beyond their reasonable control.
